Student Faces DUI With Serious Injury Charge in Tampa

TAMPA – Police today arrested the driver of a car that crashed into a concrete wall on Davis Islands in November and seriously injured a backseat passenger.

Blood was drawn from the suspect, a 20-year-old University of Tampa student, on the night of the crash, police said. After results of those tests were returned this week, detectives charged the suspectwith driving under the influence with serious bodily injury.

Seriously injured was a fellow student who suffered a lacerated liver and a broken back. No one else suffered serious injuries.

The suspect was charged today at police headquarters in downtown Tampa.

Police said the suspect was driving a 2009 Volkswagen south on West Davis Boulevard at a high rate of speed. He lost control, drove off the pavement and plowed through a concrete wall and nearly struck a home on Erie Avenue, police said. Sams was in the back seat of the car at the time.

The results of the blood-alcohol tests showed that L the suspect  had a level of .139 and .140, police said. In Florida, a driver is considered impaired with a level of .08 or higher.

A little about FL DUIs involving serious bodily injury:

  • Any person who causes serious bodily injury while driving under the influence is guilty of a Third Degree Felony (not more than $5,000 fine and/or 5 years imprisonment) or if habitual/violent felony offender as provided in s. 775.084, F.S.
  • Any person convicted of a third DUI within 10 years or a fourth or subsequent DUI commits a Third Degree Felony (not more than $5,000 fine and/or 5 years imprisonment).
