FL State Attorney’s Son Arrested for DUI in Plant City


The son of a State Attorney Bernie McCabe was arrested for DUI yesterday 3-13-10 in Plant City. Reports from the Hillsborough County Sheriff’s Office include:

  • He was arrested at 5:41 a.m. at the intersection of Stanley and Miley roads after driving into a fence.
  • He had a BAC of .168, which is over twice the legal limit of .08.
  • The crash caused an estimated $1,000 in damage to the fence and $1,000 in damage to the car.
  • He refused to perform the walk and turn exercise used to determine if someone is drunk.
  • He agreed to stand on his leg and touch his finger to his nose and failed the test.
  • Deputies described his eyes as red and watery and said he was walking unsteadily and that his breath smelled of alcohol.

The suspect was charge with DUI with property damage, he was released just before 2 p.m. after posting $500 bail.

Hillsborough County State Attorney Mark Ober’s office will handle the case, based on where the arrest was made. Bernie McCabe’s office won’t be involved.

This was the suspect’s first DUI arrest, but there was property damage involved. The maximum penalties here include a $1,000 fine and 1 year in prison as opposed to a maximum of 6 months in prison if there were no property damage.
