The Zero Tolerance Law – 0.02 or Above

What I mean by the zero tolerance law is that if you are underage (20 or younger) you can be penalized for DUI even if your BAC is lower then the legal limit of .08. In fact, you can receive a citation and possibly lose your right to drive if you have a BAC of .02 or above. The law was passed in 1997.

Normally, if an underage driver is suspected of DUI a police officer will interview them, review their drivers license and administer either a breathalyzer test or a series of field sobriety tests such as singing the alphabet backwards. If the underage suspect either fails the field sobriety tests or has a BAC above the legal limit of .08 he can be arrested for DUI on the spot. However, if the officer does not feel they have the right to arrest them for DUI under basic Florida DUI law they can use the zero tolerance law to issue a citation.

Tampa DUI Suspect Dies on the Run

The man had been arrested 26 times since 1999 on charges including grand theft, burglary, fleeing to elude arrest, trespassing, drug possession, possession of a concealed handcuff key, escaping from a juvenile facility, resisting arrest and failure to appear in court, according to records from the Florida Department of Law Enforcement.

His most recent arrest was in January on warrants for grand theft, resisting arrest and trespassing, records show.

Some of you may think, “Good another criminal off the road”, but I say it is sad this man died running from a DUI charge. However, I hope this is a lesson to a young man somewhere.

Tampa High School Teacher Charged With DUI

A Tampa teacher at Chamberlain High School has been charged with driving under the influence.

Shortly after 3 a.m. Sunday 3-14-10 he was pulled over by Tampa police after he allegedly drifted out of his lane as he drove southbound on I-275. Police also state that after they pulled him over he showed multiple signs of intoxicated including bloodshot eyes, smelling of alcohol and slurred speech.

After posting $500 bail he was released from Hillsborough County jail and released that afternoon.

From what I can tell this has not guilty written all over it. With only a drift out of his driving lane the prosecutions case seems weak. Even if he admitted being drunk at the time of the stop (which it doesn’t seem he did) a non constitutional stop could disregard anything that happened thereafter.

Tampa Man Found Asleep in Car Booked for DUI, Drug Charges

A man was found asleep at the wheel of a running car at the corner of North Boulevard and West Columbus in Drive in Tampa early yesterday 3-15-10.

After a deputy investigated he found the man had a suspended license, smelled of alcohol and fond over an once of cocaine and 54 muscle relaxant tablets in his car. He is being charged with DUI and drug charges.

The vehicle, along with $1394 in cash was impounded.

This again shows us all you do not have to be actual driving a car to be accused of driving under the influence. We are unsure of the specific drug charges, but he is most likely charged with intent to distribute which is a felony that can warrant 5 years in jail and/or a $5,000 fine upon being convicted without taking into account his unknown past criminal record. Reports: Yankees Executive Refuses Test, Charged with Tampa DUI

Yankees Executive Mark Newman Charged With DUI in Tampa

Reports indicate Mark Newman, the Yankees’ senior vice president of baseball operations was arrested for drunk driving in Tampa Monday night  after he refused to take a blood-alcohol test. It should be known that anyone who does refuse a sobriety test leaves the police officer(s) to make the arrest on their own judgment. We do not have information regarding Mr. Newman’s actual behavior or signs reported by the arresting officer that indicated he was drunk. We do know he was released on a $500 bail

Newman did not respond to a message left on his cell phone by The Associated Press and Team spokesman Jason Zillo says the Yankees can’t comment at this time.

Student Faces DUI With Serious Injury Charge in Tampa

TAMPA – Police today arrested the driver of a car that crashed into a concrete wall on Davis Islands in November and seriously injured a backseat passenger.

Blood was drawn from the suspect, a 20-year-old University of Tampa student, on the night of the crash, police said. After results of those tests were returned this week, detectives charged the suspectwith driving under the influence with serious bodily injury.

Seriously injured was a fellow student who suffered a lacerated liver and a broken back. No one else suffered serious injuries.

The suspect was charged today at police headquarters in downtown Tampa.

Police said the suspect was driving a 2009 Volkswagen south on West Davis Boulevard at a high rate of speed. He lost control, drove off the pavement and plowed through a concrete wall and nearly struck a home on Erie Avenue, police said. Sams was in the back seat of the car at the time.

The results of the blood-alcohol tests showed that L the suspect  had a level of .139 and .140, police said. In Florida, a driver is considered impaired with a level of .08 or higher.

A little about FL DUIs involving serious bodily injury:

  • Any person who causes serious bodily injury while driving under the influence is guilty of a Third Degree Felony (not more than $5,000 fine and/or 5 years imprisonment) or if habitual/violent felony offender as provided in s. 775.084, F.S.
  • Any person convicted of a third DUI within 10 years or a fourth or subsequent DUI commits a Third Degree Felony (not more than $5,000 fine and/or 5 years imprisonment).
